A CARE home owner has vowed to take Cumbria County Council to court amid claims residents' safety is being put at risk.

Documents published by the Ombudsman for Local Government and Social Care reveal the unnamed care home owner has alleged the council is not providing sufficient funding for one of her residents.

The care home accepts residents whose care is commissioned or funded by the council.

Its owner claims that one of the residents is insufficiently funded to meet his needs or is inappropriately placed.

She has complained to the Ombudsman for Local Government and Social Care (LGSCO), who said: “The complainant, who I refer to here as Mrs J, says that the council is putting at risk her ability to provide a safe environment for the residents of her Care Home because it refuses either to provide the funding needed by one of the residents, or to move him to a more suitable placement."

However a spokesman for Cumbria County Council said no official documents relating to a court case have yet been served.

The ombudsman said in their final decision: "Mrs J has a care home, which accepts residents whose care is commissioned or funded by the council.

"Mrs J says that one of the residents is insufficiently funded to meet his needs, or is inappropriately placed.

"She feels that he is putting other residents, and himself, at risk.

"However, she says the council has not agreed to provide appropriate funding or to move the resident.

"I cannot investigate the complaint because Mrs J has taken the council to court. The LGSCO is unable to consider any matter that is subject to legal action."

If a complainant has started legal proceedings the case is no longer within the ombudsman's jurisdiction.

It is not known where in Cumbria the care home is located.
