NOTICE OF MAKING OF A COMPULSORY PURCHASE ORDER
THE CUMBRIA COUNTY COUNCIL (CARLISLE SOUTHERN LINK ROAD) COMPULSORY PURCHASE ORDER 2020 (“the Order”)
THE HIGHWAYS ACT 1980 and THE ACQUISITION OF LAND ACT 1981 1.
Notice is hereby given that Cumbria County Council (“the Council”) made the Order on Monday 21 September 2020 under sections 6, 239, 240, 246, 249, 250 and 260 of the Highways Act 1980. It is about
to submit the Order to the Secretary of State for Transport for confirmation, and if confirmed, the Order will authorise the Council to purchase compulsorily the land and new rights described below for the
purposes of:
1.1 The construction of a new highway to be known as the Carlisle Southern Link Road from the A595/A689 Newby West roundabout south-eastwards for a distance of 8.1 kilometres to Junction 42 of the M6
Motorway, which falls within the parishes of Cummersdale, Dalston, and St Cuthbert Without, in the District of Carlisle and the County of Cumbria;
1.2 The construction of new roundabout junctions and improvement of existing roundabout junctions to connect the said new highway with the following existing highways which fall within the parishes of
Cummersdale, Dalston, and St Cuthbert Without;
 (a) A595 Wigton Road (b) B5299 Dalston Road (c) C1037 Burthwaite Road (d) C1041 Brisco / Wreay Road
1.3 The construction of new highways and improvements to existing highways to connect the said new highway (the Carlisle Southern Link Road) with the following existing highways within the parishes of
Cummersdale, Dalston and St Cuthbert Without;
 (a) U1161 Peter Lane (b) C1014 Buckabank Road (c) C1036 Durdar Road (d) C1036 Ivegill Road (south of Durdar)
 (e) C1037 Scalegate Road (f) A6 Principal Road (north west of M6 Motorway Junction 42)
1.4 The construction of new footpaths and cycle tracks and improvement of existing footpaths and cycle tracks in the vicinity of the routes of the above mentioned highways in pursuance of the Cumbria County
Council (A689 (Carlisle Southern Link Road) Classified Road) (Side Roads And Other Works) Order 2020 within the parishes of Cummersdale, Dalston and St Cuthbert Without;
1.5 The provision of new means of access to premises in pursuance of the Cumbria County Council (A689 (Carlisle Southern Link Road) Classified Road) (Side Roads and Other Works) Order 2020;
1.6 The diversion of non-navigable watercourses and the carrying out of other works on non-navigable watercourses in connection with the construction and improvement of the above mentioned highways and
the provision of new means of access to premises as aforesaid;
1.7 Use by the Acquiring Authority in connection with the construction and improvement of the above-mentioned highways, the diversion of non-navigable watercourses and the carrying out of other works on
non-navigable watercourses and the provision of new means of access to premises as aforesaid;
1.8 The improvement or development of frontages to the above-mentioned new and existing highways or of the land adjoining or adjacent thereto; and
1.9 Mitigating the adverse effect which the existence or use of certain of the above mentioned highways proposed to be constructed or improved will have on the surroundings thereof.
2. Copies of the Order, Maps, Statement of Reasons and associated Side Roads Order are available for inspection at Carlisle Library. Prior to visiting the Library, please make contact (using the details in the box

6. Any objection to the Order must be made in writing to the National Transport Casework Team, Tyneside House, Skinnerburn Road, Newcastle Business Park, Newcastle upon Tyne NE4
7AR or by email to nationalcasework@dft.gsi.gov.uk before Friday 20 November 2020 and should state the title of the Order, the grounds of objection and the objector’s address and interests in the
land the subject of the Order.
7. In submitting an objection it should be noted that an objector’s personal data and correspondence will be forwarded by the Secretary of State for Transport to the Council to enable the objection to be
considered. Where the Order becomes subject of Public Inquiry procedures, all correspondence is copied to the Inspector conducting the Inquiry and will be kept in the Inquiry library, which is made publicly
available. If an objector does not wish their personal data to be forwarded to the Council, the objector should state their reasons for this when submitting an objection and the Secretary of State will copy the
objection, with the objector’s name and address removed, to the Council and if there is to be a Public Inquiry the objection will be seen by the Inspector who may give the objection less weight as a result.
DESCRIPTION OF THE LAND AND THE NEW RIGHTS 1. Land to be acquired: a ‘corridor’ of land in the County of Cumbria, located to the south of Carlisle, and comprising mainly agricultural land lying between the Newby West Roundabout (at the junction of the
A595 Wigton Road with the A689 at Peter Lane) to the west, and Junction 42 of the M6 Motorway to the east, passing through the parishes of Cummersdale, Dalston, and St Cuthbert Without, and including:
Agricultural land including watercourse (Fairy Beck) and hedgerow, north-west of A595 Wigton Road and
south-west of Newby West Roundabout, forming part of Newby West Farm.
Highway land comprising Newby West Roundabout, part of A689, part of U1161 Peter Lane and part of
A595 Wigton Road, together with adjoining verge, scrub land and land within the curtilage of a property
adjoining the A595.
Fields used as part of equestrian centre forming part of Kingrigg Farm (including associated woodland and
access), near Newby West Roundabout.
Part of fields (including part of Fairy Beck) located around Newby West Roundabout and Peter Lane.
Electricity substation north of A595 Wigton Road.
Woodland south of Peter Lane and south-east of Newby West Roundabout.
Agricultural land south of Peter Lane, forming part of Skiprigg Farm.

and parts of the C1036 Durdar Road east of Stoneraise School and north of its junction with the C1014
Newbiggin Road.
2. New Rights to be Acquired:
Rights to regrade existing drainage ditches and to construct, maintain and use new drainage
outfalls and associated features including discharge to watercourses together with rights to
enter upon land with or without vehicles, plant and machinery for all purposes in connection
with such rights.
Rights to construct, renew, operate and maintain new highway overbridges (carrying the
Carlisle Southern Link Road over the Cumbrian Coast Line Railway and the River Caldew,
and over the West Coast Mainline Railway and over the River Petteril) and associated
features, including new highway (footpath and vehicle turning head), together with rights to
enter upon land, with or without vehicles, plant and machinery for all purposes in connection
with such rights.
Rights to enter upon land, with or without vehicles, plant and machinery, for all purposes in
connection with the construction, management, maintenance and use of a new otter holt on
other land.
