THE parents of a murdered nurse are set to ask questions of the Crown Prosecution Service after new evidence came to light about their daughter’s killer.

A 23-year-old woman from Preston has revealed that she reported Jonathan Vass for inciting gross indecency in 2003 after he allegedly put his hands down her pants months earlier.

He was working as a lifeguard at the time at a leisure centre in Preston.

Vass was arrested at the time, but a decision was taken within the criminal justice system that there was not enough evidence to prosecute him and he was released without charge.

Last year he murdered his ex-partner, Barrowford nurse Jane Clough, outside Blackpool Victoria Hospital.

Her parents Penny and John Clough have campaigned vigorously against the decision to allow Vass bail before he went on to murder Jane, 26, in July last year.

Penny said that the 2003 allegations were known by police and prosecutors.

The Lancashire Telegraph has examined transcripts of the two controversial bail hearings chaired by Judge Simon Newell in December 2009 and there is no reference made to the Preston incident and no attempt made by prosecutor Roger Green to refuse bail on the grounds of committing more offences.

Penny said: “We were shocked when this new evidence came to light. We spoke to our police team who said they knew about the investigation (in 2003) and that the CPS had been given information regarding this and other reported attacks by Vass for presentation to Judge Newell at Vass' bail hearing – where he was freed to kill our daughter.

“This is very significant and could have impacted on the bail decision. We have written to the CPS.”

A CPS spokesman said once they had received Mrs Clough’s letter they would consider it and respond accordingly.
