A BANNED motorist took his stepfather's car while over-the-limit and then crashed it, a court has heard.
Burnley magistrates heard how Kurt Marsden, 21, crashed after providing the music, which was coming from the vehicle, at a barbecue.
The victim at first did not report the theft, but when the defendant had not returned after three hours, he alerted the police.
Marsden, who had been disqualified for drink driving in February, was abusive to police, and refused to give a breath test, but later gave a sample showing 83 microgrammes of alcohol in 100 mililitres of breath. The legal limit is 35.
The defendant, who lives in Malvern Avenue, Padiham, pleaded guilty to aggravated vehicle taking, driving with excess alcohol, driving while banned and no insurance, on June 2.
The bench gave him a 120 day jail term, suspended for 12 months. He was also banned for three years and must pay £75 costs.
Bill Maude, prosecuting, said police spotted the car just after midnight as it was travelling though Padiham, and followed it towards Burnley.
The defendant then had a collision.
