HYNDBURN Borough Council has obtained an emergency order to close the Royal Spice takeaway in Oswaldtwistle following the tragic death of Megan Lee.

The Hygiene Prohibition Notice was made at Blackburn Magistrates Court after an environmental health officer told of below standard allergen management and mouse infestation at the Union Road premises.

The notice put before the court said: “Breaches exist in respect of food standards and food safety which have a potential and iminent risk of injury to health, namely allergen management and current infestation of mice.”

Environmental health officer Stacey Finnigan told the court she had carried out a joint investigation with trading standards at the request of the police.

Lancashire Telegraph:

"We found poor processes and procedures for allergen management and identified a mouse infestation," said Miss Finnigan. "There was an iminent threat to public health."

The takeaway will remain closed until the local authority is satisfied the problems have been rectified.

Miss Finnigan said the owner of Royal Spice, Mohammed Abdul Kuddus, had been told of the application but said he wouldn't be attending court.

A 37-year-old man from Rossendale and a 38-year-old man from Blackburn were arrested on suspicion of involuntary manslaughter by gross negligence.

They have been bailed pending further enquiries until Friday, July 7.

Megan died in Royal Blackburn Hospital from a severe allergic reaction two days after eating a takeaway.
